In our country, the rights on science and literature, music, fine art and cinema works, also known as "copyrights", are protected by the Law on Intellectual and Artistic Works (FSEK).

With FSEK, besides the authors, under the name of related rights holders, people who took part in the presentation of the work to the public were also protected. According to the law, the related rights holders are: i) Performing artists, ii) Phonogram (record) producers, iii) Radio-TV broadcasters and iv) Film producers. 

The law gives moral and financial rights to the owners of their works. Moral rights; The authority of public offering is the authority to specify the name and the authority to prohibit changes in the work.

Financial rights are the rights of processing, reproduction, dissemination, representation and transmission to the public by means of sign, sound and image transmission.

The rights granted to the affiliated right holders are as follows: 

Performing artists have the following rights:

Performing artists who interpret a work in a unique way with the permission of its owner, to identify this performance, to reproduce, sell, distribute, rent and lend it, to transmit it to the public through means of sign, sound and / or image transfer, and They have the exclusive right to allow or prohibit their retransmission and representation.

Phonogram producers have the following rights: 

Phonogram producers who are a performance product or have detected other sounds for the first time with the permission of the owner of the work and the performing artist, directly or indirectly reproducing, distributing, selling, renting and lending to the public; Public transmission and retransmission by means of signal, sound and / or image transmission; distribution of the originals or reproduced copies of the determinations that have not yet been put up for sale in the country or distributed by other means, by sale or by other means; They have the right to permit and prohibit the sale by wired or wireless vehicles or their distribution or presentation to the public in other ways and the public transmission by ensuring that natural persons can reach their determinations at the place and time they choose. 

Radio-television organizations have the following rights: 

Radio and television establishments are responsible for detecting their broadcasts, simultaneous transmission, delayed transmission, retransmission, distribution by satellite or cable by other broadcasters; the reproduction and distribution of its publications, directly or indirectly, by any technique or method, except for private uses; ensuring the transmission of broadcasts in public places; the transmission of determined publications to the public by ensuring that natural persons can reach their publications at the place and time they choose; They have exclusive right to transmit broadcast signals on or directed to the communication satellites to the public by another broadcasting company or cable operator or other third parties, and to allow or prohibit the decoding of their encrypted broadcasts. 

Film producers have the following rights: 

The film producers who made the first determination of the films, the determination made with the permission of the owner of the work and the performing artist; reproducing, distributing, selling, renting and lending to the public, directly or indirectly; Public transmission and retransmission by means of signal, sound and / or image transmission; distribution of the originals or reproduced copies of the determinations that have not yet been put up for sale in the country or distributed by other means, by sale or by other means; They have the right to permit and prohibit the sale by wired or wireless vehicles or distribution or presentation to the public in other ways and public transmission by ensuring that real persons can reach their determinations at the place and time they choose. 

Legal Sanctions 

Violations of the rights of the owner of the work and related rights protected by the Law on Intellectual and Artistic Works are subject to legal and criminal sanctions. To summarize briefly; 

Penal Provisions 

The Law on Intellectual and Artistic Works stipulates severe sanctions in case of violation of the above-mentioned rights. According to the articles 71, 72, 73 and 80 of FSEK, those who violate the rights of the authors and related right holders shall be sentenced to imprisonment from two to four years or a heavy fine from 50.000 TL to 150.000 TL or each taking into account the severity of the damage. they are condemned to both. 

Legal Provisions 

In addition to severe penal sanctions, FSEK has also made special provisions for compensation for damages to be incurred by right holders. Accordingly, right holders can demand from the courts to take all kinds of measures to prevent the damage, and three times the damage incurred from the persons who caused the violation. 

As explained briefly above, possible violations against the rights of any work, phonogram, production and radio and television broadcasts on their broadcasts constitute a crime. Therefore, without the permission of the authors and related rights holders; It is forbidden to directly or indirectly reproduce, distribute, sell, rent or distribute / sell works, phonograms, productions and broadcasts in DivX, MP3, AVI, MPG, MPEG, WMP and other formats on carriers such as CDs and DVDs.
